1. Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of the LatencyPulse web application, tools, documentation, and services (collectively, the "Service"). By accessing, browsing, or using LatencyPulse, you signify that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
If you do not agree with any part of these Terms, you must immediately terminate use of the Service. You represent that you are at least the age of legal majority in your jurisdiction or possess valid parental or guardian consent to use this Service.
2. Service Description & Nature of Calibration Utilities
LatencyPulse provides browser-accessible diagnostic instruments designed to estimate audio latency in consumer playback systems (including Bluetooth headphones, wireless earbuds, external speakers, and wired audio outputs). The suite includes visual alignment sweeps, tap tempo rhythmic synchronizers, acoustic loopback estimation, and audio-visual synchronization verifiers.
2.1 Diagnostic & Calibration Purpose Only
The calculations, figures, millisecond metrics, and feedback generated by LatencyPulse are provided solely for personal calibration, informational, and recreational purposes. LatencyPulse is not an accredited testing laboratory, acoustic certification agency, or hardware benchmark authority. Results should not be used as the basis for commercial claims, product warranty disputes, regulatory filings, or manufacturer defect claims.
3. Permitted Use & Intellectual Property Rights
The Service, including its underlying source code, visual design, user interface components, color palettes, animations, audio synthesis algorithms, graphics, and documentation, is the proprietary intellectual property of LatencyPulse and its licensors and is protected by applicable copyright, trademark, and unfair competition laws.
Subject to your adherence to these Terms, we grant you a personal, revocable, non-exclusive, non-transferable, and royalty-free license to use the Service through a standard web browser for non-commercial evaluation and calibration. You may freely copy and share your personal diagnostic text reports generated via the "Copy Benchmark Report" feature.
4. Prohibited User Conduct
You agree that you will not, directly or indirectly:
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of non-public scripts or backend infrastructure;
- Use automated scripts, bots, spiders, or scrapers to overwhelm, harvest, or extract data from the Service without express written authorization;
- Interfere with, disrupt, or compromise the integrity or security of our web servers, network infrastructure, or hosting environments;
- Circumvent or tamper with security measures, ad placements, or client-side validation logic;
- Misrepresent diagnostic estimations produced by LatencyPulse as official, certified, or laboratory-grade hardware specifications.
5. Comprehensive Disclaimer of Warranties ("AS IS")
TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, THE SERVICE, INCLUDING ALL TOOLS, DIAGNOSTICS, METRICS, SOUND IMPULSES, AND DOCUMENTATION, IS PROVIDED STRICTLY ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OR CONDITIONS OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.
LATENCYPULSE AND ITS OPERATORS EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
- Accuracy & Exactness: LatencyPulse makes no warranty that measurement figures, delay readings, or calibration offsets will be exact, error-free, uninterrupted, or mathematically identical to hardware electrical testing. Software measurements in a browser environment are influenced by operating system audio mixers (e.g., Windows WASAPI, macOS CoreAudio, Linux PulseAudio/ALSA), browser thread prioritization, CPU power-management states, display refresh rate timings, and Bluetooth codec buffer negotiation.
- Merchantability & Fitness: We disclaim any implied warranty of merchantability or fitness for a particular purpose (including live concert production, professional recording studio monitoring, broadcast genlock, competitive esports competition, or medical/audiology diagnostics).
- Continuous Availability: We do not warrant that the website will operate without temporary interruptions, server downtime, or browser compatibility regressions.
6. Strict Limitation of Liability
IN NO EVENT SHALL LATENCYPULSE, ITS CREATORS, DEVELOPERS, OPERATORS, CONTRIBUTORS, OR AFFILIATES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OR INABILITY TO USE THE SERVICE.
WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, LATENCYPULSE SHALL HAVE ZERO LIABILITY WHATSOEVER FOR:
- Commercial & Purchasing Decisions: Any financial expenditure, hardware purchasing, return fees, exchange costs, or dissatisfaction resulting from the purchase or return of wireless headphones, earbuds, DACs, audio interfaces, or computer hardware based on numbers obtained from this tool;
- Gaming & Competitive Performance: Any defeat, loss of match ranking, disqualification, or lost prize money in esports tournaments, competitive gaming, rhythm games (e.g., Osu!, Beat Saber), or live streaming;
- System & Software Alterations: Any software conflicts, registry adjustments, driver instability, or audio desynchronization arising from modifying external software settings (such as VLC delay offsets, OBS Studio sync configurations, or audio workstation preferences);
- Acoustic Exposure: Any discomfort or hearing irritation resulting from excessive audio volume levels during manual loopback or sweep testing. Users are solely responsible for keeping listening volumes at safe and moderate levels.
7. Third-Party Advertisements & Links
The Service may display third-party advertisements (such as Google AdSense banners) or hyperlinks to external websites and software applications (e.g., VLC, OBS Studio, Osu!). These links and ads are provided solely as a convenience. LatencyPulse does not endorse, control, verify, or assume responsibility for the content, privacy practices, terms, or security of any third-party websites or services.
8. Indemnification
You agree to defend, indemnify, and hold harmless LatencyPulse, its developers, operators, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorney's fees) arising out of or in any way connected with: (a) your access to or use of the Service; (b) your violation of these Terms; or (c) your infringement of any rights of another person or entity.
9. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the substantive laws applicable in our operating jurisdiction, without regard to its conflict of law principles. Any dispute, controversy, or claim arising out of or relating to these Terms or the use of the Service shall be submitted to the exclusive jurisdiction of the competent courts having jurisdiction over the operator.
10. Severability, Entire Agreement & Updates
If any provision of these Terms is found to be invalid, unlawful, or unenforceable by an authoritative court of competent jurisdiction, such provision shall be severed or limited to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
These Terms, together with our Privacy Policy and Technical Disclaimer, constitute the entire agreement between you and LatencyPulse regarding the Service. We reserve the right to revise these Terms at our discretion. Continued use of the Service following published modifications indicates your binding acceptance of the updated Terms.
